1. Acceptance of these terms

These Terms of Service govern your use of luxecandyco.com and any page, form, or message we operate under the Luxe Society Candy Co. name (together, the "Site"). By visiting the Site or joining our pre-launch list, you agree to these terms and to our Privacy Policy, which is incorporated here by reference.

If you do not agree with any part of them, please do not use the Site or submit your details. We may update these terms as the business takes shape, and the section on changes below explains how you will hear about it.

2. Eligibility

You must be at least 16 years old to join the Society or send us your contact details. If you are under 16, ask a parent or guardian to sign up on your behalf; the sticks will taste exactly the same. The Site is operated from the United States and directed to a US audience during the pre-launch period. You are responsible for complying with the laws of wherever you happen to be reading this.

If we learn that someone under 16 has joined the list, we will delete the record without needing to be asked twice.

3. The Society list is not a purchase

The Society is our free pre-launch mailing and messaging list. Joining it is not a purchase, not a pre-order, not a deposit, and not a reservation of any candy stick. No money changes hands, no inventory is held for you, and no contract of sale is formed by signing up.

Membership gives you advance notice of our launch date, first access when checkout opens, members-only stick builds, a founding launch offer, and drop alerts. It does not guarantee that any particular stick, piece, flavor, or price will exist, remain available, or be offered to you. We may close, pause, or restructure the list at any point, and we may remove any member whose behavior falls outside section 7.

4. Limited drops and allocation

Our sticks are stacked by hand in small batches, which means every drop is finite by nature. Access is offered on a first-come basis within each announced window, and completing a future checkout is what secures a stick. Member early access is a head start, not an allocation.

To keep batches from being cornered, we may cap quantities per person, per household, or per payment method, verify orders before fulfillment, and cancel or refuse any order we reasonably believe is placed by an automated tool, a reseller, or a duplicate account. Retired builds are not restocked. All of this applies once checkout opens, and it is written here so nothing about it is a surprise.

5. Product details and pricing may change

Anything shown on the Site before launch is indicative. Stick builds, individual pieces, ingredients, wrap designs, imagery, ship dates, and prices are all subject to change or withdrawal without notice while we finalize production. Photography and renderings are illustrative, and a finished stick may differ in appearance, especially the sprinkle distribution, which is an art and not a science.

We work hard to keep the Site accurate, but we do not warrant that every description, date, or figure is free of error, and we reserve the right to correct mistakes at any time, including after they have been published.

6. Email and text message consent

By submitting the signup form you consent to receive marketing email from Luxe Society Candy Co. at the address you provide. If you additionally provide a mobile number and tick the SMS box, you consent to receive automated marketing texts at that number. Consent to texts is never a condition of joining the Society or of any future purchase.

Message frequency varies, and message and data rates may apply. Reply STOP to any text to cancel, or HELP for help. Every email includes a one-click unsubscribe link. You may also write to [email protected] and we will remove you by hand. You confirm that the number you give us is yours and agree to tell us if it changes hands.

7. Acceptable use

Use the Site the way you would use a friend's candy shop. You agree not to:

• Submit an address or number you do not control, or sign anyone else up without their permission.
• Use bots, scrapers, headless browsers, or scripts to submit forms, harvest content, or monitor the Site for drops.
• Attempt to probe, scan, overload, or gain unauthorized access to the Site, its server, or its database.
• Copy, mirror, frame, or resell the Site or any substantial part of its content.
• Impersonate Luxe Society Candy Co., imply an endorsement or partnership that does not exist, or use our name or marks in advertising without written permission.
• Use the Site for anything unlawful, deceptive, or intended to harm another person.

We may suspend or block access, remove list entries, and pursue any remedy available to us if these rules are broken.

8. Intellectual property

The Luxe Society Candy Co. name, the wordmark, the candy-stick device, our stick builds and their names, wrap and packaging designs, photography, illustration, copy, and the design and code of this Site are owned by Luxe Society Candy Co. or licensed to us, and are protected by copyright, trademark, and trade dress law.

You may view the Site, share links to it, and quote short excerpts with attribution for editorial or review purposes. Everything else, including reproduction, adaptation, commercial use, and use as training input for machine learning systems, requires our prior written permission. Press and media should contact [email protected], where approved assets are available.

If you send us an idea, a stick suggestion, or other unsolicited feedback, you grant us a non-exclusive, royalty-free, perpetual license to use it without obligation or compensation. Please do not send confidential material.

9. Third-party links and services

The Site may link to social platforms, press coverage, or partner pages we do not control. Those links are offered for convenience and are not an endorsement. We are not responsible for the content, accuracy, availability, or privacy practices of any third-party site, and your dealings with them are between you and them.

10. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any launch date mentioned anywhere on the Site, including the countdown, will be met. Nothing on this Site is medical, dietary, or nutritional advice. If you have a food allergy, read the ingredient and allergen statements on the product itself before eating anything we make.

11. Limitation of liability

To the fullest extent permitted by law, Luxe Society Candy Co. and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or opportunity, arising from or relating to your use of the Site, whether based in contract, tort, or any other theory, even if we have been advised of the possibility.

Our total aggregate liability for all claims relating to the Site during the pre-launch period is limited to one hundred US dollars (USD 100). Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you, and nothing here limits liability for fraud, death, or personal injury caused by negligence where the law forbids that.

12. Indemnity

You agree to indemnify and hold harmless Luxe Society Candy Co. and its owners, employees, and contractors from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your misuse of the Site, your breach of these terms, or your violation of any law or the rights of a third party.

13. Governing law

These terms and any dispute arising from them are governed by the laws of the State of Arizona, USA, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Disputes

If something goes wrong, email [email protected] first and give us 30 days to put it right. Most problems end there, often with an apology and occasionally with candy. If a dispute cannot be resolved informally, you and Luxe Society Candy Co. agree to bring it exclusively in the state or federal courts located in Maricopa County, Arizona, and each of us consents to the personal jurisdiction of those courts.

Any claim must be brought within one year after it arises, or it is permanently barred. Claims must be brought individually and not as a class, collective, or representative action. If you are a consumer resident in the EU or UK, this section does not deprive you of the protection of your local mandatory consumer law or of your right to bring proceedings where you live.

15. Severability and waiver

If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in full force. Our failure to enforce any right is not a waiver of it. You may not assign these terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.

16. Changes to these terms

We may revise these terms as we move from pre-launch to open shop. When we do, we will update the date at the top of this page, and for any material change we will email list members before it takes effect. Continuing to use the Site after a change means you accept the revised terms.

17. Entire agreement and contact

These terms and the Privacy Policy are the entire agreement between you and Luxe Society Candy Co. regarding the Site, and they supersede anything said earlier on the subject. Questions about them go to [email protected], and we answer within 2 business days.
